Terms of Service

Welcome to Bloom Journal

These Terms of Service ("Terms") govern your use of the Bloom Journal mobile application and related services ("Service") developed and operated by an independent developer. Bloom Journal is currently in pre-launch phase and available through our waitlist program.

By accessing our website, joining our waitlist, or using Bloom Journal when it becomes available, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

Use of the Service

Eligibility

You must be at least 13 years old to use Bloom Journal. If you are under 18, you must have parental permission to use the Service. For users under 13, we comply with COPPA requirements and require verified parental consent before collecting any personal information. By using the Service, you represent and warrant that you meet these age requirements.

Account Registration

To access certain features, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and up-to-date information
• Notifying me immediately of any unauthorized use

Acceptable Use

You agree to use Bloom Journal only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Upload harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to the Service
• Use the Service for commercial purposes without permission
• Spam, harass, or abuse other users

User Content and Privacy

You retain full ownership of any content you create or upload to Bloom Journal ("User Content"), including your journal entries, photos, and personal reflections. Your privacy is paramount to me.

By using the Service, you grant me a limited, non-exclusive license to store and process your User Content solely to provide the Service features, including:

• Secure storage with end-to-end encryption
• On-device AI analysis for insights (data never leaves your device)
• Backup and sync across your personal devices

You are solely responsible for your User Content and must ensure you have the right to share it. You agree that your User Content will not violate these Terms or any applicable laws.

Intellectual Property

The Service and its original content, features, and functionality are owned by me and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any portion of the Service without my express written permission.

Privacy and Data Protection

Your privacy is fundamental to Bloom Journal's design. We implement end-to-end encryption and zero-knowledge architecture to protect your personal information. Please review our Privacy Policy, which explains:

• What personal data we collect and how we collect it
• How we use, store, and protect your information
• Your rights regarding your personal data
• How to contact us about privacy concerns
• Data retention and deletion policies

By using Bloom Journal, you consent to the collection and use of information in accordance with our Privacy Policy. You have the right to:

• Access your personal data
• Correct inaccurate information
• Request deletion of your data
• Withdraw consent at any time
• Export your data in a portable format

Service Availability and Pre-Launch Status

Important: Bloom Journal is currently in pre-launch development phase. The app is not yet available for download and we are currently building our waitlist community.

Once launched, we strive to keep Bloom Journal available and functional, but we cannot guarantee that the Service will be uninterrupted or error-free. The Service may be temporarily unavailable for maintenance, updates, or other reasons.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice to users. Your data will always remain accessible to you through export features before any discontinuation.

Subscription and Payments

Bloom Journal offers both free and premium subscription tiers. Premium subscriptions are processed through Apple's App Store and are subject to Apple's Terms of Service.

Auto-Renewable Subscriptions

• Free Trial: If offered, the free trial period will be clearly displayed before purchase. You will be charged the full subscription price after the trial ends unless you cancel at least 24 hours before the trial period expires.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Price: The current subscription price is shown in the app and is charged in your local currency through the App Store.
• Managing Subscriptions: You can view, modify, or cancel your subscription at any time by going to your iPhone Settings > Apple ID > Subscriptions, or through the Bloom Journal app's subscription management section.
• Cancellation: Premium features remain available until the end of your current billing period after cancellation. No refunds are provided for partial periods.

Refunds and Apple's Policies

All subscription purchases are final and handled according to Apple's App Store refund policies. For refund requests, please contact Apple Support directly through the App Store.

Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, I disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

I will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

Indemnification

You agree to defend, indemnify, and hold me harmless from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Account Termination and Data Deletion

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Upon termination:

• You can export all your data before deletion
• Your subscription will continue until the end of the current billing period
• Your personal data will be deleted within 30 days, except where retention is required by law
• Anonymous usage analytics may be retained for service improvement

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in activities that harm the Service or other users. In such cases, you will still have the opportunity to export your data within 30 days of suspension.

Changes to Terms

I reserve the right to modify or replace these Terms at any time. If changes are material, I will provide at least 30 days' notice before new terms take effect. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

Governing Law and Compliance

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. We comply with:

• Apple's App Store Review Guidelines and Terms of Service
• Children's Online Privacy Protection Act (COPPA)
• General Data Protection Regulation (GDPR) where applicable
• California Consumer Privacy Act (CCPA) where applicable
• Other applicable privacy and consumer protection laws

Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
